TERMS AND CONDITIONS OF USE AND SALE

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “You”) and mayush.design (“Mayush Design,” “we,” “us,” or “our”) governing your access to and use of the website located at www.mayush.design (the “Website”) and the purchase of products and/or services (the “Services”) offered therein. By accessing or placing an order through the Website, you irrevocably accept and agree to abide by these Terms, including all applicable policies referenced herein. If you do not accept these Terms, you must immediately cease use of the Website and Services.

1. DEFINITIONS

For purposes of these Terms, the following terms shall have the meanings assigned:

• “Agreement” means the legally binding contract formed between the Customer and Mayush Design upon order acceptance under these Terms.

• “Customer” means any individual or legal entity placing an Order via the Website.

• “Order” means the Customer’s purchase request submitted through the Website.

• “Services” means the full scope of products, design services, digital content, consultancy, or any other offerings made available by Mayush Design.

• “Intellectual Property Rights” means all copyrights, trademarks, trade secrets, patents, design rights, and other proprietary rights.

2. SCOPE OF TERMS

These Terms apply to all Users of the Website and Customers of Services provided through Mayush Design. They supersede any prior communications, agreements, or understandings. Separate agreements, such as service contracts, may supplement these Terms.

3. USER ELIGIBILITY AND ACCOUNT CREATION

3.1 Users affirm they have full legal capacity to enter into binding contracts under applicable law.

3.2 Users registering accounts must provide true, accurate, current, and complete information and promptly update such information to maintain accuracy.

3.3 Users bear sole responsibility for safeguarding login credentials and all actions conducted under their accounts. Mayush Design shall not be liable for losses caused by unauthorized use.

3.4 Mayush Design reserves the right to suspend or terminate accounts suspected of fraud, abuse, or violation of these Terms.

4. PRODUCTS AND SERVICES DESCRIPTION

4.1 Mayush Design endeavors to accurately describe product features, specifications, images, and prices; however, minor deviations may occur.

4.2 Product availability is subject to stock limitations and may be withdrawn or substituted at any time without prior notice.

4.3 Services are provided pursuant to detailed descriptions on the Website or as stipulated in separate agreements.

4.4 Prices and specifications are subject to change without prior notice.

5. ORDERING AND CONTRACT FORMATION

5.1 Submission of an Order constitutes an offer by the Customer to purchase specified products/services under these Terms.

5.2 Mayush Design retains absolute discretion to accept or reject Orders, including for reasons such as stock unavailability, payment issues, or suspected fraud.

5.3 A binding contract arises only upon Mayush Design’s explicit Order acceptance communicated via confirmation email.

5.4 Pricing errors on the Website do not obligate Mayush Design to honor incorrect pricing.

6. PAYMENT TERMS

6.1 Prices are quoted in Moroccan Dirhams (MAD) and inclusive of applicable taxes unless explicitly stated otherwise.

6.2 Payment must be made in full at the time of Order via Website-approved payment methods.

6.3 Customer guarantees that the payment method is legally authorized for use and indemnifies Mayush Design for any claims arising from unauthorized payment use.

6.4 Mayush Design employs secure third-party payment gateways but disclaims liability for third-party failures.

6.5 In case of disputed or fraudulent payment, Mayush Design reserves the right to cancel Orders and suspend accounts.

7. DELIVERY AND RISK TRANSFER

7.1 Mayush Design will deliver products within the estimated timeframe; however, such estimates are non-binding and contingent on factors beyond our control.

7.2 Risk and ownership of products transfer to the Customer upon physical delivery or collection.

7.3 Customers must inspect deliveries immediately and notify Mayush Design of any discrepancies or damages within 48 hours.

7.4 Shipping fees and terms are detailed on the Website and may be subject to change.

8. RETURNS, CANCELLATIONS, AND REFUNDS

8.1 Returns are subject to Mayush Design’s detailed Return Policy, which forms part of this Agreement.

8.2 Products must be returned unused, unopened, and in original packaging within 7 calendar days to qualify for refund or exchange.

8.3 Services are non-refundable upon commencement unless otherwise specified or proven defective.

8.4 Refunds will be processed within 14 business days following receipt and validation of returned goods.

8.5 Mayush Design reserves the right to refuse returns or refunds not complying with these conditions.

9. INTELLECTUAL PROPERTY RIGHTS

9.1 All Website content, including but not limited to graphics, logos, text, trademarks, and software, remain the exclusive property of Mayush Design or its licensors.

9.2 No rights or licenses are granted except a limited, non-transferable right to access and use the Website for personal, non-commercial purposes.

9.3 Any unauthorized use, reproduction, or distribution of Website content is strictly prohibited and may incur legal penalties.

10. USER CONDUCT

10.1 Customers agree to use the Website lawfully and not engage in activities that may harm the Website or other users.

10.2 Prohibited conduct includes but is not limited to: unauthorized access attempts, distribution of malicious software, infringement of rights, and dissemination of offensive content.

10.3 Mayush Design reserves the right to suspend or terminate User accounts violating these Terms without prior notice.

11. DATA PROTECTION AND PRIVACY

11.1 Mayush Design complies with applicable data protection laws and processes personal data as detailed in the Privacy Policy.

11.2 By using the Website, Users consent to collection, processing, and storage of their personal data according to said policy.

12. WARRANTY DISCLAIMERS AND LIMITATION OF LIABILITY

12.1 THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND.

12.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mayush Design DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.3 Mayush Design SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OR INABILITY TO USE THE WEBSITE OR SERVICES.

12.4 Mayush Design’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM.

13. FORCE MAJEURE

Mayush Design shall not be liable or responsible for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, wars, terrorism, labor disputes, pandemics, governmental regulations, or internet failures.

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 These Terms and any disputes arising out of or related hereto shall be governed by the laws of the Kingdom of Morocco.

14.2 Any disputes shall be exclusively submitted to the competent courts of Morocco.
